
Argus West SPEAR Program Secures Dismissal of Pharmaceutical Lien Claim, Saving Client Over $34,000

Argus West’s SPEAR Program (SIU focused lien defense) identified critical issues related to the corporate registration and asset assignments of a pharmaceutical lien claimant. This particular pharmaceutical lien claimant, a foreign corporation, surrendered its rights and authority to transact intrastate business in the State of California. As a result, the lien claimant may not collect upon the lien.
Despite these legitimate concerns, the lien claimant refused to withdraw the lien and insisted on payment of $34,408.16.
The SPEAR Program crafted a SIU focused and comprehensive Pre-Trial Conference Statement that meticulously outlined the issues surrounding the lien.
At the subsequent hearing, the lien claimant was notably absent. Argus West ensured that a Notice of Intent to Dismiss was served, formally advancing the case toward resolution. With no representation present, the Workers’ Compensation Judge (WCJ) ordered the lien to be dismissed.
