Argus West’s SPEAR Program Secures Dismissal of $28,203.77 Chiropractic Lien Due to Compliance Violations

Argus West’s SPEAR Program was tasked with managing a chiropractic lien claimant’s demand of $12,579.49 on a total lien of $28,203.77. After a thorough review of the claim, The Lien Team uncovered significant issues, including charges for shockwave therapy sessions—procedures beyond a chiropractor’s authorized scope of practice—and a lack of the required registration with the Board of Chiropractic Examiners.
Argus West requested that the lien claimant withdraw their demand due to these compliance issues. However, instead of cooperating, the lien claimant refused, resulting in the matter being set for trial. Argus West proceeded with the case, presenting findings to the court and ensuring all documentation was in order.
At trial, the lien claimant failed to provide adequate proof of licensure. Based on Argus West’s evidence, The Judge ruled that the claimant was barred from pursuing any reimbursement due to noncompliance with licensing regulations. The lien was officially dismissed, and no petition for reconsideration was filed.
