Argus West’s Spear Program Secures WCAB Dismissal Of $35,051.48 Chiropractic Lien Due to Compliance Violations
November 14, 2024
Argus West’s SPEAR Program SIU Lien Unit was assigned to manage a chiropractic lien claimant. The lien, totaling $35,051.48, was met with immediate scrutiny from Argus West SIU Lien Team, who identified significant compliance violations, including unsubstantiated charges for acupuncture, unauthorized shockwave therapy procedures, and a lack of necessary licensing documentation. The SIU Lien Team prepared a defense package identifying all the issues to be argued.
Initially, the lien claimant failed to appear at the first lien conference, prompting Argus West’s SIU Lien Team to request a Notice of Intent to Dismiss (NOI) from the Judge. However, the WCAB Judge continued the hearing, granting the lien claimant another chance to appear. When the lien claimant again failed to appear at the rescheduled conference, Argus West’s SIU Lien Unit requested the issuance of an NOI, which was granted. With no objections from the lien claimant, the lien was officially dismissed, resulting in a final paid/settlement amount of ZERO dollars, a 100% success savings.
Through Argus West’s SIU Lien Team’s diligence and commitment to regulatory compliance, the lien was dismissed, sparing the client from unwarranted financial obligations. This outcome highlights our proactive approach, SIU Provider Fraud and Abuse Unit expertise, team collaboration between the SIU Lien Team, defense attorneys and our client.
